Our Terms & Conditions .
1. Warranties:
(a) These warranties are honoured only when outstanding invoices are paid in full.
(b) One Year limited warranty for workmanship and materials:i) Covers defects in materials or faulty workmanship (installation) by Haida.
ii) If written notice is provided to Haida within one year after the invoice date Haida (in its sole discretion) will repair or replace the materials at no charge to the Customer.
iii) This warranty does not cover:
(1) glass breakage or other damage resulting from outside sources, including damages caused by misuse, abuse or lack of proper maintenance;
(2) materials not supplied or installed by Haida;
(3) breakage or other damage to materials resulting from causes other than faulty workmanship (installation).iv) Haida's liability under this warranty is limited to the wholesale cost of the materials supplied and does not cover labour costs.
(c) Five year Manufacturer's warranty on sealed units:
i) Haida will provide the Customer with the benefit of the warranty provided by the manufacturer of a sealed unit installed by Haida.
ii) Manufacturer's warranty is usually five years from the date stamped on the unit. iii) This warranty covers the cost of a new sealed unit and does NOT include the cost of labour to remove and replace the old unit.
iv) The Customer may purchase additional warranty coverage extending the warranty on the sealed unit to ten years. The cost will depend on the type and size of the unit. Haida's estimator can provide a quotation to interested Customers.(d) Windshields:
i) Haida will provide the Customer with the benefit of the warranty against leaks provided by the manufacturer of windshields.
ii) This warranty usually covers the life of the windshield.
iii) No such warranty applies for windshields supplied by the Customer and installed by Haida.(e) These express warranties are in lieu of all other warranties, whether express, implied or statutory, and all other liabilities, whether contract, tort or otherwise, including negligence. Haida makes no warranty of merchantability or fitness for a particular purpose.
(f) Haida provides no guarantee that repairs will fix skylight leaks.
2. Limitation of Liability:
(a) Haida is not be liable for any incidental, indirect, special, exemplary, punitive or consequential damages, or for lost profits, savings or revenue of any kind, whether or not Haida has been advised of the possibility of such damages. Haida's liability is limited to the warranties described above.
(b) Haida is not responsible for any loss of or damage to:i) Materials supplied by the Customer; or
ii) Materials left by the Customer on Haida's premises for longer than 60 days
resulting from any cause whatsoever including Haida's own negligence.(c) Haida is not liable for any injury, loss or damage resulting from Customer's choice or use of inappropriate glass. In particular, Haida will sell only neo-ceramic glass for fireplaces.
(d) Haida is not responsible for loss or damage resulting from the Customer's own installation or measurements.
3. Payment terms:
(a) Haida will provide a free estimate upon request.
(b) Standard terms:i) A deposit of 50% of the estimated total cost is due upon approval of the estimate.
ii) Materials will not be ordered without payment of the deposit.
iii) The deposit is nonrefundable once materials are ordered (since they are usually unique and have no value to Haida except for that customer's job).
iv) The balance of the total cost (including labour, material and taxes) is due on completion of the work.
v) Interest will be charged at the rate of 27% per annum on all unpaid invoices.
(c) Skylight repair:
i) A non-refundable flat fee of $150 will be charged for a maximum one hour site visit.
ii) Additional time will be charged at $58/man/hour.(d) Each NSF cheque will result in an additional handling fee of $25.00.
4. Time:
(a) Haida will complete each job as quickly as possible subject to factors beyond its control such as:
i) Customer demand;
ii) Supplier timeliness in delivering required materials; and
iii) Weather.
5. The Customer is solely responsible for obtaining all building and other permits.
6. Haida is not responsible for any architectural or engineering issues.
7. Customers are NOT permitted in Haida's workshop or warehouse area
8. Haida may exercise its rights under the Builders' Lien Act in addition to any other remedies available at law.
9. If the owner or contractor intends to hold back 10% of the value of Haida's work, Haida must be notified in advance of the commencement of work should the Customer require a WCB clearance letter and/or statutory declaration to permit payment of the holdback.
